hi all
just got a letter from dwp this morning to say my case is going to tribunal again [lost the first one in march ] the trouble is it's the same evidence from the same medical that i had in july 09 so unless i can get a new medical before tribunal the result will be the same even though it's a progressive illness and iv'e got worse since july 09 talk about banging your head against a brick wall. i'm sure lots of other people have this problem if you do let us know and maybe we can solve it togeather living in hope ian s

Hi Ian,
You have my sympathy and best wishes. I am in a similar position. In October last year I took early retirement on health grounds, instigated by my employer of 37 years on the basis that I could no longer perform my job adequately. I have been receiving ESA but have had it withdrawn and last week was advised that my appeal has failed. I'm now waiting for the date of my tribunal hearing. apparently I scored 9 points in my medical for being "unable to do up or undo small shirt buttons." That is supposed to sum up the total effect of a progressive illness that has ruined my life, cost me my job and very nearly resulted in me taking my life. My bitterness is now turning to hatred. It's not nice, I know, but I'm starting to hope that some of today's policy makers get the opportunity to experience my problems themselves in the fullness of time.

Dear Ian What a horrible position to be in. Could you ask for a representative from your local PD UK to go with you to the tribunal?

thanks for the post sounds like were all in the same predicament regarding the medical [i use the term loosly] as it does not have any bearing on our condition what so ever in fact it's an insult to have to go through it.beleive it or not in my medical i scored nil points even though i have a bad tremor in right hand,my toes curl under when i am standing or walk a short distance,my joints ache from head to toe,i have slowness of movement the list goes on i'm sure you know what i mean. anyway i'll keep persisting till i get some justice and i hope you will do the same i for one will be rooting for you my friend and remember don't let the bastards grind you down good luck ian s

thank for taking time out to respond,in answer to your question i have a rep from citizens advice helping me with my case who is very good at the job i think we lost the case because they could only use the evidence in front of them which was a medical done in july 09 which made it 8 months out of date, still we will carry on till we get the proper outcome all the best ian s
